0. Allgemeines

Um einen Beitrag gegen Rassismus in deinem direkten Umfeld zu leisten, kannst du in eine Polizeikontrolle einschreiten. Im Folgenden sollen dafür einige Tipps gegeben werden, wie man sich dabei verhalten kann.

Ziel einer Intervention sollte es sein, Solidarität mit Betroffenen zu zeigen und der Polizei zu symbolisieren, dass es eine kritische Öffentlichkeit gibt, so dass sie nicht unbeobachtet machen können, was sie wollen.

Bring dich dabei aber nicht selbst in Gefahr und sehe vor allem von körperlichen Aktionen gegen Cops (§§ 113, 114 StGB) ab.

Bevormunde Betroffene nicht und nimm dies auch nicht als Bühne dafür ein paar Street Credits zu ergattern.

Versuche auch nicht unbedingt, die Person zu verteidigen, denn oft hast du keine Kenntnis über sie und ein Verstoß gegen ein Gesetz kannst du nicht mit Sicherheit verneinen. Angreifbar ist meist nicht das kriminalisierte Verhalten der Person, sondern die Rechtmäßigkeit des Handelns der Polizei und nur das interessiert uns. Dazu zählt vor allem Unverhältnismäßigkeit, Verstoß gegen den Gleichbehandlungsgrundsatz Art. 3 I GG und dass sie den Betroffenen einen Beistand gewähren (dazu gleich unten).

Auch kann eine weitere Betreuung von Freund*innen der Betroffenen hilfreich sein, wenn sie mit der Situation überfordert sind.

Was nicht Ziel sein sollte ist um jeden Preis zu verhindern, dass Person mitgenommen wird. Sind bspw. die Personalien der Person nicht feststellbar, so gibt es die entsprechende Rechtsgrundlage im Sächsischen Polizeigesetz.

Der folgende Absatz wird nun einzeln auf Stufen der Intervention eingehen.

1. Beobachtung

Verschaffe dir zunächst Überblick über Situation. Dazu kannst du zunächst aus etwas Distanz beobachten, wer kontrolliert wird, was durchsucht wird und wie die Stimmung der Kontrolle ist. Dazu kannst du auch andere herumstehende Personen oder Freund*innen der Betroffenen ansprechen und mit ihnen zusammen handeln. Du hast etwas Zeit und traust dich? Dann geh etwas näher ran und symbolisiere der Betroffenen und der Polizei, dass du da bist und aktiver Teil des Geschehens werden möchtest.

2. Kontaktaufnahme Betroffene

Sprich nun aktiv die Betroffenen an und biete ihnen deine Unterstützung an. Eine rechtliche Grundlage gibt es dafür in § 14 Absatz 4 Satz 1 VwVfG (Verwaltungsverfahrensgesetz). Dadurch kannst du der Beistand der Betroffenen werden, in dem diese deiner Frage einfach zustimmen. Dieses gibt es wegen des Gebots des fairen Verfahrens und leitet sich aus dem Rechtsstaatsprinzip und der Grundrechte-Charta (EU) ab. Zwar gilt das Verwaltungsverfahrensgesetz nur im Gefahrenabwehrrecht nach den landesspezifischen Polizeigesetzen. Hingegen gilt es nicht direkt bei Strafverfolgung (schon stattgefundene Straftaten werden aufgeklärt), da dort die Strafprozessordnung angewendet wird, die spezielle Beistandsregel hat. In einer Straßensituation ist jedoch oftmals nicht klar, ob die Polizei präventiv oder repressiv tätig wird und die Situation, der Betroffene ausgesetzt sind, ist vergleichbar, sodass du auch auf dein Beistandsrecht im Falle eines Verdachtes auf eine Straftat bestehen kannst.

Du bist, im Gegensatz zur einer Bevollmächtigten*, dann keine Vertretung, sondern „nur“ zur (moralischen) Unterstützung, indem ihr gemeinsam handeln könnt. So gilt alles, was du sagst als von den Betroffenen vorgetragen, wenn diese nicht sofort widersprechen. Beistand kann jede*r werden. Eine Zurückweisung durch die Polizei ist nur unter sehr strengen Voraussetzung möglich. Zum Beispiel bei fehlender Eignung: intellektuelle (mangelnde Sachkunde) oder emotionale (persönliche Angriffe) Gründe muss es dafür geben. Lass dich nicht so schnell abwimmeln, denn dies ist ein sehr starkes Instrument, um die Kontrolle kritisch zu begleiten und den Betroffenen das Gefühl zu geben nicht allein zu sein. Die Polizei darf dich nicht wegen „Störung der Maßnahme“ wegschicken und wenn sie es doch versuchen: widersprich! Nun kann es richtig losgehen: hat die Person Sprachprobleme und benötigt eine Übersetzung? Soll jemand informiert werden? Gib der Person den Hinweis, dass sie ein Recht darauf hat, den Namen und die Dienstnummer der Beamt*innen zu erfragen. Die Rechtsgrundlage dafür ist § 11 Sächsisches Polizeigesetz (SächsPVDG – https://www.revosax.sachsen.de/vorschrift_gesamt/18193/40366.pdf)

Oft genug kennen die Beamt*innen das Beistandsrecht nicht und lassen es deswegen nicht zu. Wende dich in diesem Fall an die Öffentlichkeit, um das zu skandalisieren oder denke sogar ausnahmsweise über eine Beschwerde bei der Polizeibeschwerdestelle (Was ist das? ->https://copwatchleipzig.org/polizeiarbeit-aktuell/) nach.

3. Aufmerksamwerden Polizei

Spätestens nach der Beistandserklärung werden nun auch die Cops auf dich aufmerksam. Frage ruhig und freundlich nach dem Anlass, der Rechtsgrundlage und dem Verdacht für die Kontrolle (auch wenn sie bei der Errichtung einer Waffenverbotszone oder an “gefährlichen Orten” diesen nicht mehr brauchen). Weise sie auf das Verbot von diskriminierenden Kontrollen hin. Dazu geben dir Art. 3 I GG und das Allgemeine Gleichbehandlungsgesetz rechtliche Grundlagen. Sollten sie keine Rechtsgrundlage (oder Verdacht) haben, ist die Kontrolle unzulässig und rechtswidrig. Du kannst sie auffordern, die Kontrolle abzubrechen und alle erhobenen Daten zu löschen. Wollen sie auch deine Daten erheben ist nur das verpflichtend, was auf deinem Personalausweis steht. Rechtlich belangen können sie dich für das Beistandsein nicht, solange du nicht beleidigend oder körperlich wirst. Lasse dich nicht auf Provokationen ein und auch nicht einschüchtern! 4. Beistehen

Im weiteren Verlauf kannst du Fotos von der Situation machen. Dabei solltest du dich darauf vorbereiten, dass Cops Stress machen können, wenn sie das sehen. Die Rechtslage in Bezug auf das direkte Fotografieren von Polizist*innen ist schwierig, da gerade sie als Einzelpersonen im Mittelpunkt der Aufnahme stehen und deswegen grundsätzlich, wie alle anderen auch, durch das „Recht am eigenen Bild“ geschützt sind. Allerdings kannst du argumentieren, dass hier Beweise gesichert werden und gerade wenn körperliche Gewalt seitens der Polizei angewendet wird, deswegen ein öffentliches Interesse für die Aufnahme gegeben ist. Außerdem sind Polizeieinsätze “zeitgeschichtliche Ereignisse”, die nicht unter den Anwendungsbereich des “Recht am eigenen Bildes” fallen. Insgesamt also schwierig, auch weil deine Kamera bzw. Handy beschlagnahmt werden kann (wenn auch nur, wenn sie dir Tatsachen nennt, die die Annahme rechtfertigen, dass du sie später ohne Unkenntlichmachung der jeweiligen Beamt*in veröffentlichen willst).

Mehrere Gerichte haben entschieden, dass Filmen von Polizeieinsätzen auch keine Straftat gem. § 201 StGB (Verletzung der Vertraulichkeit des nicht öffentlich gesprochenen Wortes) ist.

Sammle die Daten von Zeug*innen, die die Situation auch beobachten, um später Beweise für den Verlauf der Kontrolle zu haben. Auch kannst du laut werden und Aufmerksamkeit von Umherstehenden generieren. Das wird die Cops sicher nerven und auch verunsichern, weil sie nun von einer breiteren Öffentlichkeit in ihrer Arbeit kontrolliert werden. Es könnte aber auch belastend für die Betroffenen sein. Hier ist also Fingerspitzengefühl gefragt.

5. Nachbereiten

Wenn die Cops abgezogen sind und die Kontrolle vorbei ist, solltest du das Geschehene nachbereiten. Gib der Betroffenen deine Kontaktdaten, um dich später ggf. erreichen zu können.

Du brauchst kein schlechtes Gewissen haben, dass du keine „richtige“ Hilfe sein konntest, indem du die Kontrolle/Gewahrsam abgewendet hast. Unsere Handlungsmöglichkeiten sind leider begrenzt und unser Ziel ist meist schon durch die kritische Begleitung und Solidarisierung erreicht. Mehr können wir oft nicht tun, aber es leistet doch einen entscheidenden Beitrag zu einer solidarischen Nachbarschaft.

Politische Einordnung

Rassismus und Repression haben noch nie Probleme gelöst, sondern immer nur neue geschaffen. Um die Probleme des Viertels anzugehen, braucht es andere Strategien. Wie oben schon angesprochen, lassen sich viele Konflikte wie Drogenhandel und Diebstahl auf strukturelle Ungleichheit im kapitalistisch verfassten Nationalstaat zurück führen, sodass dieser zum Ansatzpunkt für eine Kritik an hiesigen Zuständen sein sollte. Durch einen solidarischer Umgang miteinander können wir Perspektiven schaffen, das eigene Leben frei zu gestalten. Dazu gehört auch, dass niemand aufgrund von Herkunft, Gender (Geschlecht), sexuelle Orientierung oder Identität oder ökonomischem Status diskriminiert wird und wir einschreiten, wenn wir solches Verhalten erleben. Die Einführung der Waffenverbotszone reiht sich in eine sowohl landes- als auch bundesweite zu beobachtenden Ausbau staatlicher Repression ein.

Die gesetzliche Grundlage sollen neue Polizeigesetze ist fast allen Bundesländern schaffen (hier geht’s zum Blog des Bündnisses gegen das Sächsische Polizeigesetz: https://polizeigesetz-stoppen.de/ und https://keinpolizeigesetz.noblogs.org/). Damit findet nicht nur eine Aufstockung der Ausrüstung, sondern auch eine Ausweitung der polizeilichen Befugnisse statt.

Obwohl Kriminalitätsstatistiken das widerlegen, wird ein Bild der Eisenbahnstraße als „gefährlichste Straße Deutschlands” aufrecht erhalten. Dies steigert die gesellschaftliche Toleranz für repressiven Maßnahmen (Kontrolle, Überwachung, Verfolgung). Wie weit staatliche Strukturen gehen können, Freiheiten einzuschränken und Rechte zu nehmen, bis sich die Zivilgesellschaft darin stößt, wird zunächst an kriminalisierten Gruppen (z.B. Fussball-Fans) und Orten ausprobiert. Dass unser Stadtteil auch sehr migrantisch und alternativ geprägt ist, erhöht das Interesse der Behörden die Straßen und alles, was passiert, was lebt, unter Kontrolle zu bringen. Wir wollen die Polizei als Repressionsorgan eines Staates in den Fokus nehmen, die über das Gewaltmonopol verfügt und somit (fast) jeder Person machtvoll gegenübersteht. Diese Macht wird allzuoft ausgenutzt und vor allem im Zuge von kapitalismuskritischen und antifaschistischen Demonstrationen kommt es immer wieder zu Polizeigewalt auf Demonstrierende, Presse und Sanitäter*innen. Eine fehlende unabhängige Beschwerdestelle führt außerdem dazu, dass Cops kaum mit Konsequenzen zu rechnen haben, wenn sie unverhältnismäßig gewaltvoll und/oder diskriminierend agieren. Gerade gegenüber Migrant*innen wiegen sie sich in der Sicherheit, dass die Betroffenen, aus Angst vor dem Verlust einer ohnehin schon oft unsicheren Aufenthaltserlaubnis, keine Anzeige erstatten. Das führt zu zahlreichen Übergriffen. Zudem ist insbesondere über die Sächsische Polizei bekannt, dass sich darunter viele Amtsträger*innen mit einer rechten/rassistischen/nationalkonservativen Gesinnung befinden, wie nicht zuletzt die Bestellung eines Panzers mit Nazi-Embleme und die Vorkommnisse bei Pegida-Demonstrationen zeigen. Dass ihre politische Meinung auch ihr Handeln als Beamt*innen beeinflusst, ist zweifellos. So steht unser Engagement gegen Diskriminierung im Kontext einer Kritik an der autoritären Entwicklung der Gesellschaft, die sich sowohl auf rechtlicher Ebene (PolG) als auch durch die Zivilgesellschaft zieht (Mobilisierung von Nazis am 26.&27.8.18 nach Chemnitz, AfD-Wahlergebnisse).

What can we do?!

In order to make a contribution against racism in your immediate environment, you can intervene in a police control. In the following, some tips will be given on how to behave. The aim of an intervention should be to show solidarity with those affected and to symbolize to the police that there is a critical public, so that they cannot do what they want unobserved. But don’t put yourself in danger and refrain from physical actions against cops (§§ 113, 114 StGB). Don’t patronize those affected and don’t take this as a stage to get some street credits. Also do not try to defend the person because often you have no knowledge about them and a violation of a law you can not deny with certainty. It is usually not the criminalized behavior of the person that is vulnerable, but the legality of the police’s actions. Thats what we are interested in. This includes disproportionality, violation of Article 3 Grundgesetz and the fact that they provide assistance to those affected (see below).  Also a further support of friends of the affected persons can be helpful if they are overtaxed with the situation. What should not be the goal is to prevent at all costs that the person is taken along. If, for example, the personal data of the person cannot be determined, then there is the corresponding legal basis in the Saxon police law. The following paragraph will now deal with stages of intervention.

1. Observation

First of all, get an overview of the situation. To do this, you can first observe from a distance who is being controlled, what is being searched and what the mood of control is. You can also talk to other people standing around or friends of the affected person and act together with them. You have some time and dare? Then take a closer look and symbolize to the affected person and the police that you are there and want to become an active part of the action.

2. Getting in touch with the Affected

Speak now actively the affected person and offer to them your support. There is a legal basis for it in § 14 paragraph 4 sentence 1 Verwaltungsverfahrensgesetz (Administrative Procedure Act). Thus you can become the assistance of the affected person by simply agreeing to your question if the person wants your support. This exists because of the requirement of a fair trial and is derived from the principle of the rule of law and the Charter of Fundamental Rights (EU).

It is true that the “Administrative Procedure Act” (VwVfG) applies only to the law on the prevention of danger (state-specific police laws). On the other hand, it does not apply directly in the case of criminal prosecution (crimes that have already taken place are solved ), since the Code of Criminal Procedure (Strafprozessordnung StPO) is applied there, which has special assistance rules. In a street situation, however, it is often not clear whether the police are taking preventive or repressive action and the situation to which those affected are exposed is comparable, so that you can also insist on your right to assistance in the event of a suspected crime.

In contrast to a deputy, you are not a representative, but “only” for (moral) support, in that you can act together. So everything you say is considered to have been presented by those affected if they do not object immediately. Anyone can become an adviser. A rejection by the police is only possible under very strict conditions. For example, in the case of unsuitability: there must be intellectual (lack of expertise) or emotional (personal attacks) reasons for this. Don’t be so quick to get rid of yourself, because this is a very strong instrument to accompany the control critically and to give the affected person the feeling of not being alone. The police may not send you away because of “disturbance of the measure” and if they try it nevertheless: contradict! Now it can really start: does the person have language problems and needs a translation? Should someone be informed? Tell the person that he or she has the right to ask for the name and service number of the police (wo)men. The legal basis for this is § 11 sentence 1 SächsPVDG (Saxon police law).

Often enough, the officers do not know the right to assistance and therefore do not allow it. In this case, turn to the public to scandalize the situation or even think about filing a complaint with the police complaints office (What is this? See https://copwatchleipzig.org/polizeiarbeit-aktuell/ ).

3. Attention of the police

At the latest after the declaration of assistance, the cops will also become aware of you. Ask calmly and friendly about the occasion, the legal basis and the suspicion for the control (even if they don’t need it anymore when establishing a weapon free zone or on “criminal places”). Point them towards the prohibition of discriminatory controls. Article 3 Grundgesetz and the Gleichbehandlungsgesetz (General Equal Treatment Act) give you legal bases for this. If they have no legal basis (or suspicion), the control is inadmissible and illegal. You can ask them to stop the control and to delete all collected data.  If they also want to collect your data, only what is written on your identity card is obligatory to say. They cannot legally prosecute you for assistance as long as you do not become insulting or physical. Do not engage in provocation or intimidation! 4. Supporting

As you progress, you can take pictures of the situation. You should prepare yourself so that cops can stress out when they see that. The legal situation with regard to photographing police(wo)men is difficult because they are the focus of the photograph as individuals and therefore, like everyone else, are protected by the “right to one’s own image”. However, you can argue that evidences are documented here and especially when physical violence is used by the police, there is therefore a public interest in the recording. Moreover, police operations are “contemporary events” that do not fall under the scope of the “right to one’s own image”. All in all difficult, also because your camera or mobile phone can be confiscated. Several courts have ruled that filming police operations is also not a crime § 201 of the Criminal Code (breach of confidentiality of the non-publicly spoken word).

Collect data from witnesses who are also observing the situation in order to later have evidence of the progress of the control. You can also get loud and generate attention from outsiders. This will certainly annoy and unsettle the cops because they are now controlled by a wider public in their work. However, it could also be incriminating for those affected. A sensitive handeling is therefore required here.

5. Follow up Work

When the cops have left and the control is over you should follow up on what happened. Give the affected your data in case it is needed later.

You don’t need to have a guilty conscience that you couldn’t be a “real” help by preventing the control. Our goal is usually already achieved through critical accompaniment and solidarity. Often we cannot do more, but it makes a decisive contribution to a neighbourhood based on solidarity.

Political subsumption

Racism and repression have never solved problems, only created new ones. To address the problems of the neighbourhood, different strategies are needed. As already mentioned above, many conflicts such as drug trafficking and theft can be traced back to structural inequality in the capitalist national state, so that this should be the starting point for criticism of local conditions. By treating each other in solidarity, we can create perspectives for shaping one’s own life freely. This also means that nobody is discriminated against on the basis of origin, gender, sexual orientation or identity or economic status and that we intervene when we experience such behaviour.

The introduction of the weapon free zone is part of an expansion of state repression that can be observed both nationwide. The legal basis should be created by new police laws in almost all federal states (click here for the blog of the alliance against the Saxon Police Law: https://polizeigesetz-stoppen.de/ and https://keinpolizeigesetz.noblogs.org/). This not only means an increase in equipment, but also an expansion of police powers. Although crime statistics refute this, an image of the Eisenbahnstraße as the “most dangerous street in Germany” is maintained. This increases social tolerance for repressive measures (control, surveillance, persecution). How far state structures can go to restrict freedoms and take rights until civil society comes up against them is first tried out in criminalised groups (e.g. football fans) and places. The fact that our district is also very migrant and alternative in character increases the interest of the authorities to control the streets and everything that happens, everything that lives.

We want to focus on the police as the repressive organ of a state that has a monopoly on the use of force and is therefore powerfully opposed to (almost) every person. This power is often used and especially in the course of left antifascist demonstrations, critical of capitalism and it comes again and again to police violence on demonstrators, press and medics. A lack of an independent complaints office also means that cops hardly have to reckon with consequences if they act disproportionately violently and/or discriminatory. Particularly with regard to migrants, they weigh themselves in the certainty that those affected will not file a complaint for fear of losing an already often insecure residence permit. This leads to numerous assaults.

In addition, it is known, especially through the Saxon police, that many officials with a right-wing/racist/national conservative attitude are among them, as shown not least by the order of a tank with Nazi emblems and the incidents during Pegida demonstrations. There is no doubt that their political opinion also influences their actions as police (wo)men. Our commitment against discrimination stands in the context of a critique of the authoritarian development of society, which takes place both at the legal level (Police Law) and through civil society (mobilization of Nazis on 26 & 27 August 18 in Chemnitz, AfD election results).

You may.

Ask for the legal basis and the underlying facts for the police measure. The link must be your behaviour, not your appearance.
Contradict every single measure and have it recorded.
Demand the name and service card of a police(wo)man.
If civilians claim to belong to the police, insist on seeing the police ID.
Right to assistance: Assistance can be any person designated by the person affected by a measure and can only be refused if it proves to be absolutely unsuitable. You can act together with your adviser (no representation), which is also a good instrument if there are language problems or if you want to critically accompany the police control. The right gives you § 14 paragraph 4 sentence 1 Administrative Procedure Act (=Verwaltungsverfahrensgesetz).

In case of arrest

You are obliged to provide information about your name, date of birth, place and country of birth, nationality, marital status and registration address. Do not make any further statements or statements!
You have the right to call a lawyer. (Emergency service of lawyers Leipzig: 0172 3641041)
You have the right to refuse any testimony, both before the police and before the prosecution or the court.
Don’t be intimidated! Sometimes the officers threaten you with deportation or promise to release you if you make statements. Don’t believe them: don’t do or sign a statement!
If things or money are confiscated from you, insist on getting a record. Do not sign this protocol.
If you are not released, you must be brought before the jugde by midnight of the next day at the latest, who will then decide on your further detention (release or pre-trial detention).
You have the right to an interpreter and to contact a trusted person.

Illegalised persons can be taken into deportation custody. However, pre-trial detention has priority, § 116b StPO.
If you are released and beaten or abused, go immediately to the doctor. Have your injuries attested to there.
You can lodge an official supervisory complaint with the police president of the federal state (in Leipzig: Landespolizeipräsidium -Wilhelm-Buck-Straße 2 01097 Dresden).
You do not have to comply with subpoenas from the police, whether as a witness or accused, unless they send them explicitly on behalf of the public prosecutor’s office. Only summonses from the public prosecutor’s office (also by the police) or court are obligatory.

What may the police do?

The police act on the legal basis of the Criminal Code (StGB), the Criminal Procedure Code (StPO) for criminal prosecution and the individual state laws on public safety (police law) for averting danger. They regulate what the police may do. If it violates this, it may also file a criminal complaint against a police officer. Although only 2% of the reported cases are prosecuted in these proceedings, they may have disciplinary consequences and are included in statistics. Make a criminal complaint (after consultation with a lawyer) within 3 months of the incident to the public prosecutor, not the police.

The police may do this if you are on foot and have not committed a crime (police law).

Identity verification: They may demand your identity card if you pose a danger or a disturbance. For this purpose, concrete and recognisable facts must be available. In so-called “dangerous places” (also weapons prohibition zone) it may do so, but there must still be some connection to the dangerousness of the place. They may not control simply arbitrarily or racist motivated (racial profiling), because that offends against the principle of equal treatment from art. 3 of the Grundgesetz. If your identity cannot be established, the police may take you to the office and take fingerprints and photos, as well as external characteristics (e.g. tattoos) to find out who you are.

Expulsion: She can expel you from a place for a few hours if you are a danger or a disturbance. For this purpose, concrete and recognizable facts must be available.

Detention: She may take you to a police station if a disturbance/hazard cannot be removed otherwise, if your identity cannot be established otherwise or if this is necessary to enforce a removal order. She must give you a reason and legal remedy and give you the opportunity to call a lawyer and a trusted person. Ask to see a doctor if you’re feeling bad.

Search people and things: You (including your clothes) and your belongings may be searched if you are allowed to be detained, your identity is to be established, you are in a “dangerous place” or facts indicate that you (1) want to commit a crime on endangered objects or (2) you are carrying belongings that may be seized. The person may only be searched by persons of the same sex or by doctors.

Confiscation: One of your things may be confiscated if it is necessary to remove a disturbance or if you are allowed to be detained. This also includes the confiscation of objects that are prohibited in the weapons prohibition zone. You must be issued with a certificate of this and the legal remedy must be made known.

On 1st of January 2020 the new Saxon police law comes into force. This gives the police considerably more powers and the numbers of the §§ will change. The listed possibilities of the police change slightly: Identity findings are possible in weapons prohibition zones directly and within the area, which is 30 km away from the Polish and Czech border.

The police may do this if you are suspected of a criminal offence (Code of Criminal Procedure).

Search of things and person (§ 102 StPO): You are only a suspect if there are actual indications or facts that you have committed a criminal offence.

Physical examination (§ 81a StPO): blood sampling, urine and sweat test. These are a serious encroachment on your physical integrity, may only be performed on one*r defendant and require the theoretical consent of a judge. To prove alcohol in the blood, however, this is not necessary. You are not obliged to blow, but to tolerate the blood draw.

As a non-suspicious person (§ 103 StPO), the police may only search you if there are facts that probably contribute to the arrest of a suspect or to the securing of evidence. e.g. if, before the eyes of the police, the object of a crime (committed by another person) would be inflicted on you.

Arrest of disturbers (§ 164 StPO): Whoever interferes with the prosecution of criminal offences or administrative offences can be taken into custody until the end of the official act (max. until the end of the next day).

How to behave in case of police violence?

If you become a victim of police violence

Attempts to stop the use of violence by deescalating behaviour. If that doesn’t help, scream your pain out to get attention from passing people.
Talk specifically to potential witnesses! Tell them your name and a phone number and please contact them later.
If you later want to defend yourself legally against police violence (§ 340 StGB), the police will most likely report you for resistance (§ 113 StGB). Consult the advice of a lawyer.

If you become a witness of police violence

Make yourself available to those affected as a witness. Please bystanders to do the same. CopWatch LE has internal witness cards that you can pick up from us.
Inform the person concerned of their rights.
Offer your assistance.
In the event of an arrest, ask for the name and address of the person being arrested.

In any case

If you become a victim or witness of an arrest or (racist) police assault, record the incident as accurately as possible in a memory log:
Place and time of the incident, actions observed
the reasons given for the police action
Personal descriptions, contacts to other witnesses.
Service and helmet numbers of the civil servants inside
Police car plates.

ماذا يمكنني أن أفعل كضحية أو شاهد على عنف الشرطة واعتقالها؟

يمكنك:

طلب الأساس القانوني والوقائع الأساسية لإجراء الشرطة في تلك الحادثة.
يجب أن يكون الارتباط سلوكك، وليس مظهرك، ناقض كل مقياس على حده وقم بتسجيله.
اطلب اسم وبطاقة الخدمة لرجل/امرأة الشرطة.
وإذا زعم المدنيون أنهم ينتمون إلى الشرطة، فأصر على رؤية هوية الشرطة.
الحق في المساعدة:
يمكن أن تكون المساعدة أي شخص يعينه الشخص المتضرر من جراء ما ولا يمكن رفضها إلا إذا ثبت أنها غير مناسبة تماما. يمكنك أن تعمل مع مستشارك (بدون تمثيل)، وهو أيضا أداة جيدة إذا كانت هناك مشاكل في اللغة أو إذا كنت ترغب في مرافقة الشرطة بشكل ناقد.
ويعطيك الحق:
الفقرة 14 من المادة 4 من قانون الإجراءات الإدارية رقم 1 (=Verwaltungsverfahrensgesetz).

في حالة الاعتقال:

أنت ملزم بتوفير معلومات حول اسمك وتاريخ ميلادك ومكان ولايتك وبلدك وجنسيتك وحالته الزوجية وعنوان التسجيل.

يحق لك رفض أي شهادة، سواء أمام الشرطة أو أمام النيابة أو المحكمة.
لا تخافوا! وفي بعض الأحيان، يهددك الضباط بالترحيل أو يعدوا بإطلاق سراحكم إذا أدليتم ببيانات. لا تصدق ولا تفعل أو توقع على اي بيان!
إذا تمت مصادرة أشياء أو أموال منك، فأصر على الحصول على مستند. لا توقع هذا البروتوكول إذا لم يتم إطلاق سراحكم، إذا لم يتم الإفراج عنك، فيجب مثولك أمام القاضي بحلول منتصف ليل اليوم التالي على أبعد تقدير، والذي سيقرر بعد ذلك احتجازك الإضافي (الإفراج عنك أو الاحتجاز السابق للمحاكمة).
يحق لك الاستعانة بمترجم فوري والاتصال بشخص موثوق به.

ويمكن احتجاز الأشخاص غير الشرعيين في عهدة الترحيل. غير أن للحبس الاحتياطي الأولوية، المادة 116 B) ) من القانون الجنائي.
إذا تم إطلاق سراحك وضربك أو إساءة معاملتك، اذهب فورا إلى الطبيب، لقد شهد على إصابتك هناك.


يمكنك تقديم شكوى إشرافية رسمية إلى رئيس الشرطة في الولاية الاتحادية في لايبزيغ: Landespolizeipräsidium -Wilhelm-Buck-Straße 2 01097 Dresden).
ولا يتعين عليك أن تمتثل للاستدعاءات الصادرة عن الشرطة، سواء كشاهد أو متهم، ما لم ارسالها صراحة بالنيابة عن مكتب المدعي العام. ولا يلزم سوى الاستدعاءات من مكتب المدعي العام (وأيضا من قبل الشرطة) أو المحكمة.

ماذا يمكن للشرطة أن تفعل؟

وتعمل الشرطة على أساس قانوني (القانون الجنائي) وقانون (الإجراءات الجنائية) (STPO) للمقاضاة الجنائية، وقوانين الدولة الفردية المتعلقة بالسلامة العامة (قانون الشرطة) لتجنب الخطر. والاخيرة تنظم ما قد تفعله الشرطة. وفي حالة انتهاك هذا القانون، يجوز لك أيضا أن تقدم شكوى جنائية ضد ضابط شرطة. وعلى الرغم من أن 2% فقط من الحالات المبلغ عنها تتم ملاحقتها في هذه الإجراءات، إلا أنها قد تكون لها عواقب تأديبية وقد تكون مدرجة في الإحصاءات. تقديم شكوى جنائية (بعد التشاور مع محام) في غضون 3 شهرا من الحادث إلى المدعي العام، وليس إلى الشرطة.

قد تفعل الشرطة ذلك (ايقافك او سؤالك) إذا كنت على الأقدام ولم ترتكب جريمة (قانون الشرطة).

التحقق من الهوية:
قد يطلبون بطاقة هويتك إذا كنت تشكل خطرا أو اضطرابا. ولهذا الغرض، يجب أن تكون هناك حقائق ملموسة يمكن التعرف عليها. وفيما يسمى “الأماكن الخطرة” (منطقة حظر الأسلحة أيضا) قد تفعل الشرطة ذلك، ولكن لا يزال هناك بعض الارتباط بخطورة المكان.
ولا يجوز لهم أن يتحكموا ببساطة على نحو تعسفي أو عنصري (التنميط العنصري) لان ذلك يتعارض مع مبدأ المساواة في المعاملة من المادة 3 من اتفاقية غريندغيسيتز.
إذا تعذر إثبات هويتك، فقد تأخذكم الشرطة إلى المكتب لأخذ بصمات الأصابع والصور، بالإضافة إلى الخصائص الخارجية (مثل الوشم) لمعرفة من أنت.

الطرد:
يمكن طردك من مكان لبضع ساعات إذا كنت خطرا أو اضطرابا. ولهذا الغرض، يجب أن تكون هناك حقائق ملموسة يمكن التعرف عليها.

الاحتجاز:
يجوز أن يتم نقلك إلى مركز شرطة إذا تعذر إزالة أي اضطراب أو خطر، أو إذا تعذر إثبات هويتك أو إذا كان ذلك ضروريا لتنفيذ أمر الإزالة. يجب أن يتم اعطائك سبباً وعلاجاً قانونياً والفرصة لاستدعاء محام وشخص موثوق به. أطلب رؤية الطبيب إذا كنت تشعر بالسوء.

البحث عن أشخاص وأشياء:
أنت (بما في ذلك ملابسك) وقد يتم البحث في متعلقاتك إذا سمح باحتجازك، سيتم إثبات هويتك، أنت في “مكان خطير” أو تشير الحقائق إلى أنك (1) ترغب في ارتكاب جريمة على أجسام معرضة للخطر أو (2) أنك تحمل متعلقات قد يتم الاستيلاء عليها. ولا يجوز تفتيش الشخص إلا بواسطة أشخاص من نفس الجنس أو بواسطة أطباء.

المصادرة:

قد تتم مصادرة أحد مقتنياتك إذا كان من الضروري إزالة أحد الاضطرابات أو إذا تم احتجازك. ويشمل ذلك أيضا مصادرة أشياء محظورة في منطقة حظر الأسلحة. يجب أن يتم إصدار شهادة بهذا الأمر ويجب أن يتم التعريف بالعلاج القانوني.

وفي الأول من يناير/كانون الثاني 2020 بدأ نفاذ قانون الشرطة السكسونية الجديد.
وهذا يعطي الشرطة سلطات أكبر بكثير، وسيتغير عدد من الفقرات. وتتغير إمكانيات الشرطة المذكورة تغيرا طفيفا: فنتائج تحديد الهوية ممكنة في مناطق حظر الأسلحة مباشرة وداخل المنطقة التي تبعد 30 كيلومترا عن الحدود البولندية والتشيكية.

ويجوز للشرطة القيام بالتالي ذكره إذا اشتبه في ارتكابك جريمة جنائية (قانون الإجراءات الجنائية):

البحث عن الأشياء والشخص (البند 102 من قانون العقوبات):
أنت فقط مشتبه فيه إذا كانت هناك مؤشرات أو حقائق فعلية بأنك قد ارتكبت جريمة جنائية.

فحص بدني: الفقرة 81 a (StPO)

أخذ عينات الدم والبول واختبار العرق. هذه تعد تعديا خطيرا على سلامتك البدنية ولا يجوز إجراؤها إلا على المدعى عليه، وتحتاج إلى موافقة نظرية من القاضي. لإثبات الكحول في الدم، ومع ذلك، هذا ليس ضروريا. أنت لست مجبر على نفخ الهواء، ولكن لتحمل سحب الدم.

كشخص غير مريب (الفقرة 103 من المادة 1 من القانون)
لا يجوز للشرطة أن تفتشك او توقفك إلا إذا كان هناك وقائع قد تسهم في القبض على مشتبه فيه أو في تأمين الأدلة، على سبيل المثال، إذا كان موضوع الجريمة (التي ارتكبها شخص آخر) سيقع عليك أمام أعين الشرطة.

توقيف المزعجين (البند 164 من قانون الإجراءات الجنائية):
يمكن احتجاز كل من يتدخل في مقاضاة الجرائم الجنائية أو الجرائم الإدارية حتى نهاية العمل الرسمي (بحد أقصى حتى نهاية اليوم التالي).

كيف تتصرف في حالة عنف الشرطة؟

إذا وقعت ضحية عنف الشرطة:
محاولة وقف استخدام العنف من خلال الحد من السلوك. وإذا لم يكن هذا مفيدا، فالصرخ الماً لكي ينتبه المارة.
تحدث تحديدا إلى الشهود المحتملين! أخبرهم باسمك ورقم هاتفك، ويرجى الاتصال بهم لاحقا.
إذا كنت تريد في وقت لاحق أن تدافع عن نفسك قانونيا ضد عنف الشرطة (المادة 340 StGB)، فإن الشرطة على الأرجح سوف تبلغ عن المقاومة (البند 113 StGB). راجع مشورة المحامي.

إذا أصبحت شاهدا على عنف الشرطة:
جعل نفسك متاحا للمتضررين كشاهد. يرجى المارة للقيام بالمثل.

على أي حال :

إذا وقعت ضحية أو شاهدا على اعتقال أو اعتداء (عنصري) على الشرطة، فسجل الحادث بأكبر قدر ممكن من الدقة في سجل الذاكرة:
مكان ووقت الحادث، ولاحظ الإجراءات، الأسباب التي دعت الشرطة إلى التقدم
وصف شخصي، واتصالات بشهود آخرين.
أرقام الخدمة والخوذة لموظفي الخدمة المدنية، داخل لوحات سيارات الشرطة.
